Recent investment arbitration disputes have prompted critics to point out shortcomings in the process, including lack of transparency, high costs, and a tendency to needlessly politicize proceedings. While arbitration remains a popular means of resolving disputes, are the traditional mechanisms outdated and in need of reform? What changes could be put in place to improve dispute settlement?
