The United Nations Conference on Trade and Development (UNCTAD) estimates that pharmaceutical markets are characterized by low elasticity of demand, which is often caused by the lack of alternatives to life-saving medicines and the abundance of regulatory requirements. Another key characteristic of these markets is the substantial market power enjoyed by the suppliers of original drugs as the patent owners. How do the antitrust authorities in BRICS countries and other developing jurisdictions work within the anti-competitive practices of Big Pharma, which restrict innovation and growth of the industry? What are the most common forms of abuse in the markets today? What are the key trends demonstrated by these practices and is current antitrust regulation sufficient to counter them effectively? Have the progressive measures taken in antimonopoly regulation against anti-competitive practices to moderate innovation in the industry (compulsory licensing, access to platforms, etc.) been successful? Can a competition policy help innovation? How do the legal systems of BRICS countries adapt the flexible regulatory instruments provided for by the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) and the Doha Declaration on the TRIPS Agreement and Public Health? How relevant is the global intellectual property protection regime in the innovative development of the pharmaceutical industry in BRICS countries and in expanding the access of their citizens to the latest medical products? How does the competition policy correlate with the development goals and with the objectives of stimulating innovation? What joint steps can the antitrust authorities in BRICS countries take to spread technologies and knowledge more effectively around the world and ensure the development of BRICS economies?

Alexey Ivanov – Harvard University (LLM), Russian School of Private Law (Master of Private Law), Director of the HSE-Skolkovo Institute for Law and Development. Since 2012 Alexey has been teaching a course of lectures on Antitrust Regulation in the New Economy at the Higher School of Economics Faculty of Law. This course addresses the key challenges for development of competition law and policy over a backdrop of dramatic technological change. Alexey has long-standing professional experience in the court system, the public federal service, as well as in leading positions in large commercial energy and steel companies. For five years Alexey has served as Director of the Department for Legal Policy and Social Development at the Skolkovo Foundation, where he has been involved in research and legislative work aimed at the promotion of innovative activity in Russia. Aleksey is a director of the BRICS Antimonopoly Centre that specializes in reseach of pharmaceutical and digital markets of BRICS nations.

Anna Numerova

Partner, Egorov Puginsky Afanasiev & Partners

Anna Numerova has been advising on competition law matters since 2007. She deals with a wide range of antitrust law issues and represents clients before the Federal Antimonopoly Service of Russia (the FAS Russia) in course of cartel investigations and cases on abuse of dominance. Her client list include industrial and mining businesses, as well as pharmaceutical companies from Russia and abroad. She works a lot on mandates from pharmaceutical sector clients advising them on public procurement, trade policy implementation and compliance, M&A antimonopoly clearance and many everyday legal issues related to their operations in Russia.
Anna is a member of Competition Experts Association, and of the Non-Profit Partnership “CIS Competition Support Association”. For over eight years Anna has served as a member of General Council of Competition Experts Association, and acted as Chairwoman of the latter for four years. She also plays an active role in the specialist committees of the International Bar Association (IBA) and the American Bar Association (ABA). In 2015 Anna was awarded a Second-Class Medal of the Order of Merit for the Motherland.

Marwan Akar

Tembinkosi Bonakele

Commissioner, Competition Commission of South Africa

Tembinkosi Bonakele has been the Commissioner of the South African Competition Commission since 2013. Mr Bonakele joined the Commission in 2004 and occupied various positions in the Commission’s core divisions. He was appointed Deputy Commissioner in 2008, and prior to that worked as head of mergers, head of compliance, and senior legal counsel respectively. Mr Bonakele’s accomplishments at the Commission include establishing the Cartels division.
Mr Bonakele is an admitted attorney and previously practised with Cheadle Thompson and Haysom in Johannesburg largely in the areas of labour law, regulation, and health and safety. He has also spent a year working in corporate finance and antitrust groups at Clifford Chance, New York office.
He has recently co-edited a book titled, Competition Law for the New Era. He holds a BJuris and an LLB from the University of Fort Hare and an MBA from Gordon Institute of Business Science, University of Pretoria. Mr Bonakele currently serves as the Chairperson of the African Competition Forum, is a member of the BRICS competition forum and a member of the International Competition Network Steering Group. Bonakele is also a member of the JSE’s Take-Over Regulation Panel and is the Chairperson of Buffalo City Development Agency. Bonakele is an activist who has been a leader in the youth and student movement and is a former President of the Student Representative Council of the University of Fort Hare.
He is a recipient of the Black Management Forums’s Black Excellency Award and is a regular speaker at international competition policy conferences.

Matthias Wernicke

Matthias holds a Master’s as well as Doctor’s degree in Economics from Oxford University, UK.
Before joining Merck, he was a Partner at McKinsey & Co in Berlin providing consulting services to customers from the pharmaceutical and healthcare industry.
Matthias joined Merck in 2014 as a European Head of Market Access & Pricing.
From June 2015 to September 2017, Matthias Wernicke was Managing Director of Merck Austria, based in Vienna.
In October 2017, Dr.Wernicke was appointed General Manager of Merck Biopharma Russia & CIS.

Dennis Davis

Judge, President, Competition Appeals Court of South Africa

Judge Dennis Davis was educated at Herzlia School, Universities of Cape town (UCT) and Cambridge. He began teaching at UCT in 1977 and was appointed to a personal chair of Commercial Law, in 1989. Between 1991 and 1997 he was Director of the Centre for Applied Legal Studies of the University of the Witwatersrand. He held joint appointment at Wits and UCT 1995 - 1997. He was appointed a Judge of the High Court in 1998 and as President of the Competition Appeal Court in 2000. Since his appointment to the Bench, he has continued to teach constitutional law and tax law at UCT where he is an Hon. Professor of law.
Dennis is a member of the Commission of Enquiry into Tax Structure of South Africa and was a Technical Advisor to the Constitutional Assembly where the negotiations for South Africa's interim and final constitutions were formulated and concluded. He hosted a TV programme, Future Imperfect which was an award winning current affairs programme between 1993-1998.
He has been a visiting lecturer/professor at the Universities of Cambridge, Florida, Toronto and Harvard.

Hans Duijf

Vice-President, Russia and Belarus, Novo Nordisk

Hans Duijf was appointed Vice President of Novo Nordisk in Russia and Belarus since September 1, 2017.
Mr. Duijf is a Dutch national, born in June 1974. He moved to Moscow with his family, wife and two daughters, from Colombia, where he held the position of General Manager of the Novo Nordisk affiliate since 2015.
Mr. Duijf has nearly 20 years of experience in the affiliates and regional headquarters of Novo Nordisk in established and developing markets in Europe, South-East Asia and Latin America. Under his leadership diverse teams of different cultures consistently succeeded in improving performance and introducing innovative approaches. Mr. Duijf began his career in sales and marketing in the UK, and later participated in the product launching in the markets of different countries. He has extensive management experience in positions such as Marketing Director, Business Development Director, General Manager, Vice President.
Hans Duijf has received education in international marketing and strategic management and holds a Master of Science (M.Sc.) degree in Business Administration from Rotterdam School of Management, Erasmus University in the Netherlands.

Natalia Kolerova

General Manager, Oncology Department, Russia, Ukraine and CIS, Novartis AG

Natalia Kolerova became the Oncology General Manager at Novartis in April 2014. In this position she supervised the development of the oncological segment in Russia, Ukraine and the CIS. Since 2017, she also holds the position of General Director at Novartis Pharma LLC in Russia.
Natalia joined Novartis in 2008 as the head of a new business unit of specialized medicine. In this position, she managed to efficiently organize the operations of the unit and successfully bring six new products to the Russian market, including Galvus® and Gilenya®. Later, Natalya headed the unit of introducing pharmaceutical products into the market, where she supervised the accessibility of pharmaceuticals from the company’s oncology portfolio at the federal and regional levels.
Natalia graduated from the Sechenov Moscow Medical Academy with a degree in Pharmacology, as well as the Lomonosov Moscow State University with a degree in Sociology. She holds an MBA degree.
Before joining Novartis, Natalia held senior positions at the Russian representative offices of the international pharmaceutical companies Abbott Lab SA and Sanofi-Aventis.

Payal Malik

Economics Adviser, Head of the Economics Division, Competition Commission of the Republic of India

Payal Malik is Adviser, Economics and Head of the Economics Division at the Competition Commission of India. She is on secondment from PGDAV College, University of Delhi, where she is an Associate Professor of Economics. Formerly she has been a visiting Senior Research Fellow LIRNEasia. She was also visiting National Law University Delhi and teaching a course on Economics of Competition Law to the LLM students. Her areas of expertise are competition law, policy and regulation. She has several years of research and economic consulting experience in network Industries such as power and telecommunication, ICTs, Innovation systems, and Infrastructure.
Previously she has been a senior consultant at the Center for Infrastructure and Regulation, National Council of Applied Economic Research (NCAER), India. At NCAER she has been a lead researcher on various infrastructure development projects including Telecom, Electricity, Highways, and Water and Sanitation. She was on the team that drafted the Electricity Act of India ushering competition into the sector.
She has a BA (Hons.) in Economics from Lady Shri Ram College, University of Delhi and an MA and MPhil in Economics from the Delhi School of Economics. She also has an MBA in finance from University of Cincinnati, Ohio.

Since May 2017 Irina Panarina has been appointed to the position of General Manager of AstraZeneca, Russia and Eurasia. Irina is responsible for AstraZeneca business in Russia & Eurasia Area and she leads AstraZeneca Russia.
Irina Panarina has worked for AstraZeneca since 2009. In October 2015 Irina joined the Russian team as Cardiovascular and Metabolic Disease Business Unit Head. Before coming to Russia, Irina Panarina held the position of General Manager at AstraZeneca Ukraine.
Prior to joining AstraZeneca Irina held regional roles at GSK Pharma headquarters in London, UK.
Irina Panarina has work experience in marketing, product portfolio management, people development.

Vikram Singh Punia

Graduated from Birla Public School in Pilani. In 1992 started his higher education in Russia, at Irkutsk State Medical University. Later graduated from the Far Eastern Federal University, majoring in Finance and Credit. Married, with three children.
Founder of Pharmasyntez, member of the Leaders’ Club to Promote Business Initiatives (a non-profit partnership), Co-Chairman of the Business Council for Cooperation with India, participant in several investment forums and business missions.
Pharmasyntez manufactures medicinal drugs for socially significant diseases, such as tuberculosis, HIV/AIDS, cancer, hepatitis and diabetes. The company’s profile includes over 113 various pharmaceutical forms and dosages – caps, pills, granules, IV solutions, sterile dry powders, solutions for injection and lyophilisates. A year later, he was appointed as a Chief of Staff of the First Vice-Governor - Chairman of the Finance Committee of St. Petersburg City Administration. Under his guidance a set of law enforcement acts and administrative rules of Saint-Petersburg Administration in the sphere of state finance management were elaborated.From 1999 till 2004 – Director of scientific-research programs, executive director of “EPICENTER –Saint- Petersburg Foundation”. Is a draftsman of several legislative initiatives at the State Duma of the Russian Federation in the sphere of economy, finance, taxes and antimonopoly policy.Since 2004 – Deputy Head of the FAS Russia, since July 2006 till now – Stats-secretary – Deputy Head of the FAS Russia.
